But panty & stocking is Japanese because Gainax made it and Avatar is American because an American studio made it. the staff isn't going just by style, but by who actually made it.

If it actually is Japanese, it's acceptable. However, when the only evidence available points to it being non-Japanese, that's the conclusion that must be reached. In the case of Panty & Stocking, there is evidence all over the internet proving that it was made by a Japanese company. However, as for this image, with no watermark, or artist tag, or source link, all we have to go on is the art style. The conclusion, therefore, is that it is not Japanese. That same conclusion would be made for Panty & Stocking if no one knew about it and there were no way to attribute it to a Japanese person.

This is, I've seen this image on random pay-for-hentai sites, with similar art style, so I'm pretty sure it's not Japanese. But that's not enough proof. I'd have to find said site.
