Super late on this, but apparently Xerblade doesn't know how Japanese laws work.

Cousins, adopted siblings, AND step-siblings are all fair game to them. If it wasn't for his loyalty to Asuna (and Kirito still could have just given her up or simply cheated), Kirito would be clear to smash Suguha if he wanted, more so since she already was in love with him.
