I would assume that picture is legal due to its non sexual base. why he has that avatar is beyond me. but the real question is how did you find it, his account seems almost completely inactivate.

Given that the comment counter is broken, it's perfectly possible that this guy has hundreds of comments and Justsayin found one of them while browsing the site normally.

That being said, avatars have been stripped for lesser reasons than this. I've contacted lozertuser directly and let him know about it.

Probably not legal...

Though a user has been banned for having an image of a giant dick for his avatar so why not a naked child? (Granted, it probably wasn't a Japanese dick nor anime related dick)

Are admins or mods capable of force changing a user's avatar? I remember Lozer mailing me asking me to change mine once, so I figured he had little control over it.

Since lozer has full database and filesystem access to the servers, he can indeed force changes, even if it means deleting the avatar from the server and manually changing the database reference to the default avatar.

It is legal in the USA (Nude =/= porn) and the ToS doesn't strictly prohibit it, however, the mods have agreed that photos of real children should be rating:safe and loozer has gone with this decision in the past.

When avatars where new we didn't have any rules regarding them so we figured that anything that didn't violate the ToS was OK. Though, as a private site, the administration has the right to remove any content for any reason. We often tolerate off-topic avatars and even NC-17 avatars but some push the boundaries of acceptability. Would you mind seeing this pasted all over the forum? While I don't think it's that bad I would still say it's inappropriate even for this site.

On a side note: I have seen this collection myself. It involves FKK-like family get-togethers in Europe where the children where body painted and played on a nude beach. There was no sexual content nor where the children taken advantage of in any way. They are legal photos of innocent childhood fun.

Even if it is technically legal. It doesn't exactly do much damage just to remove the image.

The only damage from misunderstanding the legality of an image, is when you actually take legal action against someone you shouldn't. That isn't happening here on Gelbooru so I say go ahead and purge it.

That's my opinion.
